Have you been arrested in Quebec or elsewhere in Canada and don't know what to do? Here are some tips☟

1.Keep silent : As trivial as it may seem, this is the most valuable advice any lawyer can give you. Note that the right to silence is a fundamental right enshrined in the Canadian Charter of Rights and Freedoms . Rest assured, exercising your right to silence does not amount to a confession;

 

2.Ask to speak to a lawyer : You have the right to consult a lawyer without delay. Use your right by quickly asking the police officer to speak to a lawyer (before you are asked any questions). If you do not know a lawyer, ask to speak confidentially to a legal aid lawyer;

 

3.Remain calm and courteous in your behavior while remaining silent;

 

4.Do not resist arrest : Do not physically resist, even if you believe the arrest is unjustified. Resistance can make the situation worse;

 

5.Document your arrest : As soon as possible after the incident, write down everything you remember, before, during and after the arrest, in as much detail as possible including the date, time, location, presence of witnesses or not, the number of police officers present, and the circumstances of the arrest.
